He is right about having to sue. One of the requirements for keeping a trademark on anything is that you are active in it's defense. If you slack off and don't sue people for infringement, you can actually loose the mark.
It sucks, and is dumb, and I have a feeling that particular bit of the copyright code was written by lawyers who giggled themselves to sleep the night it passed.
Don't take this as me disagreeing with your assertion that Gary Fong is a money grubbing bag of yak scrotum. He certainly is, and made most of his money in real estate, rather than photography like he wants you to believe.
